Terms of Service

Tracely is a proof-of-work time tracking platform. These terms explain how clients and workers use Tracely, how screenshot-based proof of work works, and how subscriptions, account deletion, and support requests are handled.

Welcome to Tracely. These Terms of Service explain the rules for using Tracely, including our website, dashboard, desktop tracker, and related services.

By creating an account, starting a trial, using the desktop tracker, accessing the dashboard, or using any part of Tracely, you agree to these Terms. If you do not agree, please do not use Tracely.

1. What Tracely Provides

Tracely is a proof-of-work and time tracking platform designed for clients and workers.

Tracely allows clients to create projects, invite workers, review tracked work sessions, and view screenshot-based proof of work. Workers can use the Tracely desktop tracker to manually start and stop tracking sessions, during which screenshots may be captured at random intervals to support transparent work verification.

Tracely is intended to help clients and workers maintain clear records of time worked and proof of work completed.

2. Client and Worker Roles

Tracely supports two main user roles: Clients and Workers.

Clients can create projects, invite workers, manage project access, review assigned work sessions, view screenshots, and manage subscription access.

Workers can join projects through invitations, use the desktop tracker, start and stop work sessions, review their own screenshots, and delete screenshots during the available review window.

A user's available features may depend on their role, project assignment, subscription status, and account permissions.

3. Screenshot-Based Proof of Work

Tracely uses screenshot-based proof of work.

When a worker manually starts a tracking session, the desktop tracker may capture screenshots at random intervals based on the project's screenshot frequency settings.

Screenshots are only captured during active tracking sessions. Tracely does not perform silent background tracking. Workers control when tracking starts and stops.

After a screenshot is captured, workers may have a limited review window to delete the screenshot before it becomes visible to the assigned client. Deleted screenshots are not counted as proof for the related work interval.

4. Worker Control and Transparency

Tracking in Tracely is voluntary and user-controlled.

Workers must manually start tracking before screenshots are captured. Workers can stop tracking at any time.

Tracely is not designed for hidden employee surveillance, silent monitoring, or background screen recording. Clients should ensure that workers understand how Tracely works before asking them to use it.

5. No Client-Worker Payments Through Tracely

Tracely is a proof-of-work and time tracking tool only.

Tracely does not process payments between clients and workers, hold funds, provide escrow services, manage invoices, issue payouts, or control financial agreements between clients and workers.

Any contracts, invoices, payment terms, rates, or financial arrangements between clients and workers are handled independently outside Tracely.

Tracely may display project-related rates, tracked time, or billable summaries for record-keeping and transparency, but these records do not represent payment processing by Tracely.

6. Accounts and Account Security

You are responsible for maintaining the confidentiality of your account login details and for all activity that occurs under your account.

You agree to provide accurate account information and keep your email address up to date.

You must not share your account access with unauthorized users, impersonate another person, or attempt to access accounts, projects, sessions, or screenshots that you are not authorized to view.

7. Acceptable Use

You agree not to use Tracely for unlawful, harmful, abusive, or unauthorized purposes.

  • Attempt to bypass security or access controls.
  • Interfere with the operation of the service.
  • Upload malicious files or attempt to compromise the platform.
  • Use Tracely to monitor someone without their knowledge or consent.
  • Misrepresent tracked work, manipulate sessions, or misuse screenshot records.
  • Use screenshots or work records outside the intended client-worker project relationship.
  • Use Tracely in a way that violates applicable laws or the rights of others.

Clients are responsible for ensuring that their use of Tracely with workers is lawful, fair, and transparent in their jurisdiction.

Workers should only use Tracely when they understand and agree that screenshots may be captured during active tracking sessions.

8. Subscriptions, Billing, and Free Trial

Tracely may offer a free trial so clients can evaluate the product before purchasing a paid subscription.

Paid subscription billing is handled by our payment provider, Lemon Squeezy. Tracely does not directly store full payment card details.

Subscription pricing may be based on plan type, number of users, seats, or other usage limits displayed at the time of purchase.

Clients are responsible for managing their subscription and ensuring billing information remains accurate and up to date.

Workers invited by clients are not billed directly by Tracely unless they separately create and use a paid client account.

9. Cancellation and Access

You may cancel your paid subscription according to the billing options available through the billing portal or by contacting support.

When a subscription is cancelled, access may remain available until the end of the current billing period unless otherwise stated.

If a subscription expires, is cancelled, becomes past due, or payment fails, Tracely may limit access to paid features, including project management, worker access, screenshot review, or new tracking activity.

10. Refunds

Tracely provides a free trial so users can evaluate the product before subscribing.

Because Tracely is a digital SaaS product with access provided after purchase, payments are generally non-refundable unless required by law or approved on a case-by-case basis.

11. Account Deletion

Users may request deletion of their account by contacting support@gettracely.com.

For client accounts, Tracely will not delete the account while there are active projects, active worker assignments, or ongoing work sessions linked to that account. Before deletion can proceed, the client must first complete, close, or otherwise resolve all active projects and worker assignments.

This rule helps protect workers from unexpectedly losing access to work logs, screenshots, or proof-of-work records connected to active projects.

Once eligible for deletion, Tracely may delete or anonymize account information, project records, session records, and screenshots in accordance with our Privacy Policy, retention rules, and legal or operational requirements.

12. Data and Privacy

Your use of Tracely is also governed by our Privacy Policy. The Privacy Policy explains what data we collect, how screenshots are handled, how data is stored, and what rights users have regarding their information.

13. Screenshot Responsibility

Screenshots may contain visible information from a worker's screen during active tracking sessions.

Workers are responsible for ensuring they do not display sensitive, private, confidential, personal, or unrelated information while tracking is active.

Clients should use screenshot records only for legitimate work verification and should not misuse, disclose, distribute, or publish screenshots outside the intended project relationship.

14. Service Availability

We aim to keep Tracely reliable and available, but we do not guarantee uninterrupted or error-free service.

Tracely may occasionally be unavailable due to maintenance, updates, third-party service issues, hosting interruptions, or other technical reasons.

We may update, improve, suspend, or discontinue parts of the service when necessary.

15. Third-Party Services

Tracely may use trusted third-party services for hosting, storage, email delivery, subscription billing, and infrastructure.

These may include cloud hosting providers, cloud storage providers, email delivery providers, and payment processors.

We use these services only as needed to operate Tracely.

16. Limitation of Liability

To the maximum extent permitted by law, Tracely is provided on an "as is" and "as available" basis.

Tracely is not responsible for indirect, incidental, special, consequential, or punitive damages, including loss of profits, lost business opportunities, lost data, or disputes between clients and workers.

Tracely does not guarantee that screenshot records, time records, or billable summaries will resolve disputes between clients and workers.

Users remain responsible for their own agreements, communication, contracts, invoices, and payment arrangements.

17. Termination

We may suspend or terminate access to Tracely if a user violates these Terms, misuses the service, creates security risk, or uses the platform unlawfully.

You may stop using Tracely at any time. You may also request account deletion by contacting support@gettracely.com.

18. Changes to These Terms

We may update these Terms from time to time to reflect product changes, legal requirements, or operational improvements.

When we make material changes, we may notify users through the website, dashboard, email, or other reasonable means.

Continued use of Tracely after the Terms are updated means you accept the updated Terms.
